These Terms & Conditions apply to the Pilot Ventures website located at www.pilotnw.com and all other sites, mobile sites, services, applications, platforms, and tools where these Terms & Conditions appear or are linked (collectively, the “Site”). As used in these Terms & Conditions, “Pilot”, “us” or “we” refers to Pilot Ventures LLC DBA Pilot Property Management and its subsidiaries and affiliates.
Please read the following Terms & Conditions carefully as they affect your legal rights. The Terms & Conditions do not alter the terms and conditions of any agreement you may have with Pilot or its affiliates. Except as expressly set forth otherwise in a signed agreement between you and Pilot, the Terms & Conditions are the entire agreement between you and Pilot and supersede all prior or contemporaneous negotiations, discussions or agreements between you and Pilot about this Website.
USE OF COPYRIGHTED MATERIALS/TRADEMARKS
Any materials on the Website, including without limitation any documentation, content, text, data, graphics, images, video and audio clips, interfaces or other materials, information or works of authorship are copyrighted materials (i) owned by Pilot (collectively, the “Materials”) or (ii) provided by third party licensors and suppliers to Pilot (collectively, the “Third Party Content”). All rights not expressly granted in and to the Website, the Materials, and the Third Party Content are reserved to their respective owners, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. You agree to abide by all copyright notices and trademark, information and other restrictions in connection with the Website, including without limitation any Materials and Third-Party Content therein.
The Materials contain trademarks, service marks and trade names which are owned by Pilot and its affiliates. To the extent Pilot manages a property where you are renting, you must rely solely on your own investigation and conclusions regarding such home, including without limitation conclusions involving construction, engineering, and financial matters. Information on the Website should not be relied upon for accuracy, timeliness and completeness and projections, forecasts and estimates on the Website are not guarantees or current or future performance.
LIMITATION OF LIABILITY
IN NO EVENT SHALL PILOT BE LIABLE TO YOU OR ANY THIRD-PARTY CLAIMING THROUGH YOU FOR ANY DAMAGES IN CONNECTION WITH YOUR USE OF THE WEBSITE, YOUR INABILITY TO USE THE WEBSITE OR ANY CONTENT APPEARING ON THE WEBSITE. IN NO EVENT WILL PILOT BE LIABLE TO YOU OR ANY THIRD-PARTY CLAIMING THROUGH YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, SPECIAL OR INCIDENTAL DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES ARISING FROM CLAIMS RELATED TO PERSONAL INJURY OR DEATH, LOSS OF DATA, LOST REVENUE, LOST PROFITS, LOSS OF USE OR OTHER ECONOMIC ADVANTAGE, CHANGE IN APPLICABLE GOVERNMENT REGULATIONS, REGARDLESS OF THE FORM OF THE ACTION AND REGARDLESS OF WHETHER PILOT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE NOTWITHSTANDING THE FOREGOING LIMITATIONS, IN NO EVENT WILL THE TOTAL, CUMULATIVE LIABILITY OF PILOT FOR DAMAGES UNDER THE TERMS & CONDITIONS EXCEED ONE HUNDRED DOLLARS ($100.00). SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
PRESS RELEASES
The information contained within press releases issued by Pilot and its affiliates should not be deemed accurate or current except as of the date the release was posted. Pilot and its affiliates have no intention of updating, and specifically disclaim any duty to update, the information in the press releases.

INDEMNITY
You agree to defend, indemnify and hold harmless Pilot and its affiliates, officers, directors, owners, operators, employees, licensors and agents, from and against any and all claims, actions, demands, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from, related to or in connection with: (i) your use of and access to the Website, including without limitation any Materials contained herein; (ii) your violation of any of these Terms & Conditions; and/or (iii) your violation of any third-party right, including without limitation any Third Party Content or any other third party copyright, property, or privacy right in connection with your use of or access to the Website.
GENERAL PROVISIONS
Enforcement of the Terms & Condition will be governed by Washington law, excluding its conflict and choice of law principles. The exclusive jurisdiction and venue for any claims arising out of or related to the Terms & Conditions or your use of the Website will lie in the state or federal courts located in Washington and you irrevocably agree to submit to the jurisdiction of such courts. The failure of Pilot to enforce any right or provision in the Terms & Conditions will not constitute a waiver of such right or provision unless acknowledged and agreed to by Pilot in writing. In the event that a court of competent jurisdiction finds any provision of these Terms & Conditions to be illegal, invalid or unenforceable, the remaining portions will remain in full force and effect.
SMS TERMS & CONDITIONS
Pilot offers a mobile messaging program (the “Program”), which you agree to use and participate in subject to these SMS Terms and Conditions. By signing up or opting in to or participating in any of our Programs, you agree to receive text messages from Pilot as a form of communication regarding your inquiries, rental application, tenancy, or other notices. By opting-in, you accept and agree to these terms and conditions, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration. This Agreement is limited to the Program and is not intended to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Pilot in other contexts.
- Message Frequency: You will receive SMS messages from us at the frequency agreed upon when you opt in. Standard message and data rates apply.
- Possible Fees: Message and data rates may apply.
- User Opt-In: Users may receive SMS/MMS mobile messages by affirmatively opting into the Program, such as through online or application-based enrollment forms. Regardless of the opt-in method utilized to join, you agree that this Agreement applies to your participation in the Program. By participating in the Program, you agree to receive SMS/MMS at the phone number associated with your opt-in.
- Opt-Out: If you do not wish to continue receiving messages or no longer agree to this Agreement, you agree to reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from Pilot in order to opt out of the Program. You may receive an additional mobile message confirming your decision to opt out. You may also contact us for assistance (contact information below).
- Support/Help:For support or help with SMS messages, reply to any message with the word HELP or contact us (contact informatino below).
- Content: SMS Messages may include promotional content, alerts, and other information related to Pilot. We will not send any messages that violate any laws or regulations, or contain any content that is abusive, obscene, or otherwise objectionable.
- Personal information: We will collect and use your personal information for the purpose of sending SMS messages and improving our services. We will not share your information with third parties, except as necessary to provide SMS services or as required by law. For more information, see Pilot’s Privacy Policy.
- Disclaimer: Neither the Carriers nor Pilot are responsible for delayed or undelivered messages, or for any damages resulting from SMS messages, including but not limited to damages for loss of business profits, business interruption, or loss of data.
